Arrested for DUI in Las Vegas, NV
You’ve only had a couple of drinks and you don’t really consider yourself drunk and especially not DUI worthy. You didn’t make plans for a ride home and a cab or a bus is out of the question because of a couple of drinks. You’re driving down the road, driving the speed limit, minding your own business, except you turn the corner and go a little wide, just to be cautious, then all of a sudden Blue lights appear in your mirrors.
An unnecessarily wide turn is only one of the many reasons police in Las Vegas can pull you over and suspect you of DUI. Some of the more obvious offenses are if you’re straddling the center line, you almost hit something, weaving, swerving, slow speed (more than 10 mph below the speed limit), stopping for no reason in the traffic lane, following too close, tires touch the center or right lane markers, braking erratically, turning abruptly or illegally, accelerating or decelerating rapidly or you’re a dumbass driving with your headlights off when it’s dark.
As you can see, you can be pulled over for just about anything and if you happen to be drunk enough that you’re eyes are red, you’re slurring your speech a little or you smell like alcohol, the officer will suspect you or driving under the influence and will perform the required field sobriety tests, you will probably fail, because the field sobriety tests are designed so you will fail.
What are your options when you see blue lights in your mirrors?
Before you see blue lights there are a few things you can do to make yourself appear to be more in control. Have your insurance and registration ready. If you have to dig through all of your crap in your glove box, you’re going to appear nervous and you’re giving the officer time to look around and look through your crap.
Clean your car out. If the inside of your car is trashed, the officer is going to want to go through it and who knows what might be under the Burger King wrappers from last week when your friends were in your car.
When you see lights in your mirror, pullover. Don’t be stupid and make matters worse.
You don’t have to answer any questions besides your name and address. Don’t agree to perform roadside tests, these are designed so you will fail.
Don’t agree to have your eyes tested with the officers little flashlight. When the officer tells you to follow the light with your eyes from side to side, he’s looking for your pupils to vibrate. Once you look to the extreme left or right, your eyes vibrate with the strain of stretching to look to the extreme. If you’re drunk your eyes will start vibrating sooner than normal. Which is subjective and really only a doctor can tell the difference and is really only the officers untrained opinion.
You don’t have to agree to blow into the field handheld breat tester.
You DO have to consent to a breath or blood test if the officer asks you to take one.
Be polite. Get sarcastic or belligerent and you’re giving the officer an excuse to arrest you.
